Ontario Pork submission regarding monetary penalties for environmental contraventions

Ontario Pork submitted comments to the Ministry of the Environment, Conservation and Parks (MECP) regarding expanding administrative penalties for environmental contraventions.

Ontario Pork firmly believes that an administrative penalty should be proportional to the risk to the environment caused by the infraction. Ontario Pork agrees with the importance of accountability; however, we also believe that there are many different approaches that can be taken. The consideration of due diligence and/or mitigation measures must be a significant factor in considering if an AMP is even going to be applied to an agricultural operation.

Ontario Pork is also concerned with the elimination of the Ministry’s practice of cooperative education and awareness abatement programs and the previous emphasis on assistive compliance.

Ontario Pork submitted comments to the Ministry of Natural Resources and Forests (MNRF) regarding proposed changes to their Administrative Monetary Policy, as the Ministry is proposing to expand applicable legislation to include: 

  • Environmental Protection Act
  • Nutrient Management Act
  • Ontario Water Resources Act
  • Pesticides Act and
  • Safe Drinking Water Act

Ontario Pork believes that any Administrative Monetary Penalty (AMP) should be proportional to the risk to the environment caused by the infraction and take into account both risk management due diligence, as well as mitigation efforts to lessen any environmental damage.

We strongly recommend that the money collected from agricultural operations under this framework be reinvested into the agricultural community, enhancing existing agricultural environmental cost-share programs.
